FAS initiated a case in the ALV supply market

Signs of illegal coordination of economic activity were revealed in the actions of the Swiss company Hamilton Medical AG/

The FAS Russia conducted on-site inspections of a number of official distributors of artificial lung ventilation (ALV) devices manufactured by Hamilton Medical AG.

The Authority revealed that Hamilton Medical AG sent instructions to its distributors (economically dependent subjects of legal relations) on participation in state and municipal procurement. As a result of such actions, competition between distributors was actually eliminated, which led to the division of the commodity market according to the territorial principle and the composition of buyers, as well as maintaining prices at auctions.

The FAS Russia has initiated an antimonopoly case* against Hamilton Medical AG on the grounds of coordinating the actions of the manufacturer’s official distributors when participating in state and municipal purchases for ALV supply.

If the company is found guilty, it faces an administrative fine in accordance with the Code on Administrative Offences of the Russian Federation.
